Background
[APPLICANT A] has run her beauty salon in Iran for sixteen years, with a recognised local and social media presence and recent profitable accounts. She wished to travel to New Zealand for about three weeks to visit her sister, [SPONSOR], a New Zealand citizen. Two earlier visitor visa applications had been lodged and refused from overseas, the first in December 2023 and the second in June 2024, both on the basis that she had not sufficiently shown her ties to Iran and so was not accepted as a genuine visitor. In July 2024 she engaged us to prepare a fresh, fully evidenced application.
Our approach
We authored a lengthy cover letter that worked through the genuine visitor test point by point. It set out her strong ties to Iran: a sixteen year business with a renewed licence and lease, recent profitable accounts and tax clearance, two properties, a vehicle, bank balance certificates, and a documented ten year history of sixteen international trips with no breaches. It explained the purpose, length and funding of the short visit, supported by a sponsorship form from her New Zealand citizen sister together with the sponsor’s passport, business, payslip, funds and property evidence. Family letters from the applicant, her sister and their parents, staff letters offering to verify details, and translations of all Farsi documents completed a comprehensive set of evidence.
Outcome
The value of the matter lies in the detailed submission and the comprehensive set of evidence assembled to overcome two earlier refusals. Immigration New Zealand was satisfied and the visitor visa was granted.
Lessons
After a visitor visa is refused from overseas there is no right of appeal or reconsideration, so the only way forward is a fresh application that carries new and materially stronger evidence than the one that failed, because simply relodging the same material invites the same result. The genuine visitor test is won on ties to home, so business continuity, property and vehicle ownership, bank balance certificates and a clean multi year travel history should all be documented, translated and presented as a coherent picture of a life the applicant will return to. Sponsorship from a New Zealand family member carries more weight when it is formalised and backed by the sponsor’s own status, income and assets, and where there are earlier refusals the submission should explain head on why this application is different so the officer can see the earlier concerns have been answered.
